According to an EPA memo issued on July 16, the agency has clarified that "islanded" power generation facilities that serve a single private consumer without connecting to the grid fall outside the scope of the Acid Rain Program under the Clean Air Act. The clarification centers on self-contained plants like those powering data centers; the EPA determined that such facilities do not meet the definition of generators selling electricity "primarily for use by the public." A concrete example cited was a proposed 500 MW natural gas facility designed exclusively for a single data center. The ruling applies equally to dedicated power infrastructure serving other private consumers, including Bitcoin mining operations. While the facilities still must comply with other Clean Air Act provisions and state regulations, removing Acid Rain Program compliance meaningfully reduces regulatory burden and project timelines.
