According to a US Department of Justice filing yesterday, the Trump administration urged a federal judge to dismiss the NAACP's Clean Air Act lawsuit against xAI Corp., arguing that the case threatens national security and AI innovation. The DOJ said xAI's Colossus gas power plant, which operates 57 unpermitted turbines, supplies critical energy to the Colossus 2 data center that powers Grok, a system relied upon by the Department of War.
The filing cited that Grok's Gov Model aided targeted military operations, helping US forces deploy over 2,000 munitions to 2,000 distinct targets within 96 hours during Operation Epic Fury in Iran. The NAACP separately filed lawsuit materials on June 12, alleging xAI violated environmental regulations by operating turbines without air permits in Southaven, Mississippi.
